Genomic Express Licensure and Accreditation

Genomic Express is a California and U.S. Federal government licensed clinical laboratory. The Genomic Express laboratory is CLIA certified for high complexity testing in Human Genetics.

The Clinical Laboratory Improvement Amendments (CLIA) were implemented by the United States federal government in 1988. It applies to all clinical laboratory testing performed on humans in the United States for the purpose of providing information: (1) for the prevention, diagnosis or treatment of disease or impairment, and/or (2) for the assessment of health. The CLIA system is designed to ensure the accuracy and precision of testing, and quality control of laboratory operations. Genomic Express was issued a CLIA certicicate of Compliance from the U.S. Centers for Medicare and Medicaid Services (CMS) and received a Clinical Laboratory License from the State of California Department of Public Health (CDPH) in February, 2012.

At Genomic Express, we believe that access to, and control over, personal genetic information is an intrinsic right of each individual.  You have a right to confidentially obtain, understand and control use of your own genetic information.  Our company standards are designed with these principles in mind and our operating policies ensure that these standards are met.

("Genomic Express", "we"  "our") is committed to protecting the personal, medical and genetic privacy of its users ("consumer", "users", "you", "your").   In addition to the privacy standards for routine medical information, we recognize that you may be concerned that genetic information might be inappropriately used by employers and/or insurers. Therefore, the Genomic Express genetic testing services, website and computer networks and databases have been developed with security controls to protect this information.

We are committed to protecting the privacy of your personal and genetic information. Nevertheless, we do collect personal information from you in order to provide additional content, process orders and properly counsel you about genetic tests and your test results. The details of our privacy policy are described below and govern your interaction with the Genomic Express website.  By using our website, you agree to the collection, storage and use of this information as set forth in this policy. 1. INTRODUCTION

There are two ways you can view and interact with the Genomic Express website:

Access Genomic Express website without registration 

You may access and use our website without registration.  The public portion of our website is viewable at www.genomicexpress.com.  You may view the public portion of our site without registration, and registered users may view the site without logging in.  Under these circumstances, we only collect non-personal information.  Non-personal information is information that is not traceable back to your person or used to identify you, and includes the information described below (Collection and Use of Information). Non personal information is collected through the use of our site tracking and standard web "cookies".  These are small data files that are stored on the hard drive of a computer used to view websites, and that are accessible only by the party or site that placed the cookie on the hard drive.  Cookies are unable to execute any code or virus. 

You do not need to accept cookies on your computer in order to use our website.  Most internet browsers allow you to choose settings that control whether and how cookies will be accepted by your browser.  Instructions can usually be found in the "Help" section of the browser toolbar.  We only utilize cookies to optimize our website functionality and user experience.

Access Genomic Express website via registration

In order to view all the content and features of our website, as well as order genetic tests and other services and view your test results, you will need to register an account with Genomic Express.  At the time you choose to do this, we collect and store personally identifiable information.  This is information that can be traced back to you, and includes the information described below (Collection and Use of Information).   Depending on the genetic test or other service ordered and site functions utilized, we may collect additional personally identifiable information to facilitate your use of our site or your decision regarding whether a test or service would be appropriate for you.  It is your responsibility to ensure the accuracy of your personally identifiable information, as it will affect the information you receive and other aspects of the functionality of our site.  You have the option of changing some of your personally identifiable information when logged in to your personal and secure account.   It is important that your email address be kept current because that is the primary manner in which we communicate with you.  You are responsible for maintaining the confidentiality of your personal account by not disclosing your username and password to others.  

2. COLLECTION AND USE OF INFORMATION

Non-Personal Information

We collect non-personal information to improve the performance, content and functionality of our website.  When users view the public portion of our website (i.e. without registering or without logging in), we collect and cumulate which pages of our website were visited, the order in which they were visited, the length of time spent on each page, which hyperlinks were followed and what other functionalities of the site that were utilized.  In order to collect such information, our server logs the IP addresses, operating system and browser software used by each user of the website. This information does not personally identify you but does record the IP address of a user's Internet Service Provider and the geographic location of connectivity.

Personally Identifiable Information

We do collect personally identifiable information that you provide when you register as a Member and/or purchase a genetic test or other service with Genomic Express.  When you register, you will provide a Username and valid e-mail address.  These are unique and will specifically identify you.  If you choose a Username already registered by another Genomic Express Member, you will be prompted to choose another Username. The e-mail address must be valid and you must be able to access it in order to activate your Membership and/or make a purchase.  At the time you choose to provide this information, you will be prompted to enter a password.  This password is required to login to your account and may be changed by you when logged in.  Your e-mail address is the primary means by which we communicate with you, so you should keep it up to date.  You may change your e-mail when logged in as a user.    Should you forget your password, we can send it to your registered e-mail upon request.  Your unique Username and password allow you to gain access to the non-public portion of our site, including your personal and secure account.  You are responsible for maintaining the confidentiality of your personal account by not disclosing your username and password to others.  

Additional Personally Identifiable Information

Purchase Orders

Additional personally identifiable information is collected in order for you to purchase a genetic test or other genomic service.  This includes your billing, shipping and credit card information.  This information is collected to process your order, process payment for the order, update you on testing progress and notify you when your test is complete and the results are posted in your personal account.  All purchase orders are made via credit card and are processed through third parties.  These third parties are provided your billing and shipping information that is necessary to provide the e-commerce service.  We do not disclose, nor allow these third parties access to, your genetic test results or other personal information in your account.   

Genetic Test Results and Other Genomic Information

Genetic test results are posted in your personal, secure and password protected online account.  Depending on other Genomic Express services and functionalities of our website that you utilize, additional Personal Information may be collected and stored.  This may include responses to questionnaires, surveys or risk assessments.  This information is collected in order to facilitate use of various functionalities of our website, help you decide whether a genetic test or service would be useful for you, and to understand what information is (and is not) provided by the test or service.  It may also be utilized for proper reporting  and counseling you regarding your genetic information.  It is important that this personally identifiable information you choose to provide is accurate since it will affect the information and counseling you are provided.

3.  MINORS

Genomic Express is committed to protecting the privacy of its Members, including children.  Our website, genetic tests and services are not intended to attract children.  A parent or guardian may, however, do any of the following on behalf of his or her child:  1) establish an account on behalf of his or her child,  2) complete and save a questionnaire, survey or risk assessment;  3) order a genetic test or other genomic service;  4) review and store the result posted to the account generated for the minor.  For genetic tests performed on a minor (under 18 years old), a parent or legal gurdian must sign the Informed Consent included in the collection kit.  The parent or guardian assumes full responsibility for the information submitted on behalf of the minor as well as maintaining the confidentiality of any of the minor's genetic test results.

4.  LINKED SITES

For your convenience, and in order to improve the informational value of our website, we include links to websites operated by other organizations or companies that may be of interest to you.  We do not disclose your personal information to these linked sites.  Genomic Express is not responsible for the privacy policy, and does not endorse the content of, these sites.  Should you choose to link to one of these sites, you should review the privacy policy posted on that site to understand how they collect and use any personally identifiable information. 

5.  DISCLOSURES REQUIRED BY LAW

There is the possibility that personal information may be subject to disclosure pursuant to judicial or other government subpoenas, warrants, or orders.  If we are legally compelled in the future to disclose personally identifiable information about you to satisfy a court order, subpoena, government request, law, regulation or other legal process, Genomic Express will use reasonable and lawful efforts to limit the scope of any such legally required disclosure.  In the event Genomic Express, Inc. is directed to make such a disclosure, we will make every attempt to notify you in advance insofar as we are legally permitted to do so.

 6.  PRIVACY POLICY SUBJECT TO CHANGE

Genomic Express periodically reviews its practices and, from time to time, may alter its procedures in order to improve the privacy of its customers.  We reserve the right to change our privacy practices and, in such case, will modify this Privacy Policy here on our website.  A notice that our Privacy Policy has been modified will be placed on our website, but we will not otherwise contact you about the change.  Please bookmark this page and review periodically to be familiar with our current Privacy Policy.

7.   BUSINESS TRANSFERS

In the event that Genomic Express is acquired by or merges into another company, personally identifiable information or other information possessed by Genomic Express may be transferred to the successor.  In such instance, we will require that the successor comply with the terms of this Privacy Policy.

Genomic Express provides, here on our website, information about genomics and genetic testing. This includes general educational materials, information about new genetic discoveries and new genetic tests under development.

For genetic tests that we offer, Genomic Express provides the following resources:

• Information about the health, lifestyle or medical condition for which the test is relevant.
• Information and tools, including online questionaires, to help you decide whether a particular test is appropriate and would be useful for you.
• What information the genetic test can (and can not) give you.
• Recommended actions for particular test results.
• Online ordering of genetic tests. Once you have decided to take a test and place your order, we do the following:
  1. Set up your own Genomic Express secure, personal online account.
  2. We mail you (two day delivery) a test kit with instructions for collecting your DNA sample. This is a buccal swab which merely requires running a sterile cotton swab along the inside of your cheek.
  3. You complete the test kit and return it directly to our testing lab in the pre-paid envelope.
  4. When your test results are reported, we notify you by e-mail and you can log-on to your own secure account to view your Personal Report.
  5. For medical genetic tests, we can provide access to a qualified genetic counselor for explanation and discussion of your test results.
• Testing is performed in the Genomic Express Molecular Genetics Laboratory which is CLIA certified for high complexity testing in Human Genetics.
• Confidentiality and security of your genetic information. Your genetic test results will be posted to your personal online account. This account is established at the time you order a test. It is password protected so that you control access to your genetic test results. Anonymous genetic testing is available if desired.
• No genetic tests, other than the one(s) you specifically ordered, will be performed on your DNA sample. Unlike other genetic testing companies, Genomic Express does not conduct any research using your DNA. Unless you choose to use one of our other services, such as personal DNA banking/archiving, your DNA sample will be destroyed after your genetic tests are completed.

Genomic Express was formed in November, 2006 based on pioneering molecular genetics research conducted by BitTech, Inc. BitTech was incorporated in 1993, and the majority of the company's research was supported by competitive peer-reviewed research grants awarded by the U.S. National Institutes of Health. A majority of this research was in the area of genetic testing, and led to the launch of Genomic Express in 2008. The Genomic Express state-of-the-art molecular genetics laboratories are located in Westlake Village, California.
